It is illegal for an attorney to make a referral fee payment to a non attorney.
The Texas Bar Rules allow attorneys to make referral fees to other attorneys for personal injury cases.
The rules essentially state that an attorney can receive a referral for accepting joint responsibility for the prosecution of the case or receive compensation based upon the proportion of professional services rendered in any matter.
I make referrals to other attorneys based upon the “joint responsibility” clause of Rule 104 of the State Bar Rules.
I will make a referral fee in the amount of 1/3 of the attorney’s fees I recover in any case referred to me by another attorney.
